1. Is interest on Lease Rental Discounting (LRD) loans capped under Section 24(b)?

Statutory Position: No. While interest deduction on self-occupied residential property is capped at ₹2,00,000 per annum, interest paid on loans borrowed for let-out commercial property (including Lease Rental Discounting facilities utilized for business or asset creation) is 100% uncapped against let-out income under Section 24(b) of the Income-tax Act, 1961.

2. What are the statutory penalties for omitting US RSUs in Schedule FA of Indian ITR?

Statutory Position: Under Section 43 of the Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015, failure to disclose foreign shares, vested RSUs, or foreign custodial accounts in Schedule FA attracts a mandatory penalty of ₹10,00,000 (Ten Lakh Rupees) per assessment year, even if all taxes were duly withheld on vesting under Section 192/17(2). Past omissions can be regularized by filing an updated return (ITR-U) with complete Table A3 schedules.

3. Can commercial lenders or bankruptcy liquidators attach assets held in a Private Family Trust?

Statutory Position: Under the Indian Trusts Act, 1882, assets irrevocably transferred to an Irrevocable Discretionary Family Trust cease to form part of the settler's personal balance sheet. Provided the trust deed is drafted bona fide prior to the execution of commercial bank guarantees or insolvency triggers, the trust corpus is protected from creditor attachments and IBC liquidation.

4. What are the mandatory jurisdictional preconditions before an AO can issue a Section 148 notice?

Statutory Position: Under Section 148A, the Assessing Officer must possess verifiable 'information suggesting income has escaped assessment', conduct a preliminary inquiry, provide the assessee with complete underlying documents via a show cause notice (giving 7 to 30 days to reply), pass an order under Section 148A(d) considering objections, and obtain statutory sanction from the Principal Chief Commissioner under Section 151.

5. How can an eligible startup claim the 100% tax exemption under Section 80-IAC?

Statutory Position: To claim the 100% tax holiday on eligible profits for 3 consecutive assessment years out of 10 years under Section 80-IAC, the entity must be a DPIIT-recognized company or LLP incorporated between April 1, 2016 and March 31, 2025, have turnover under ₹100 Crores, and receive approval from the Inter-Ministerial Board (IMB).
